House bill would empower vulnerable and older adults

HB 149 set for a House hearing this afternoon

SANTA FE – The New Mexico Aging and Long-Term Services Department (ALTSD) is urging lawmakers to support House Bill 149 and champion supported-decision making, giving New Mexican adults more choices.

House Bill 149: Supported Decision-Making Act, sponsored by Rep. Michelle Abeyta, Rep. Joanne Ferrary and Rep. Charlotte Little, is scheduled for a hearing in the House Judiciary Committee this afternoon at 1:30 p.m. in Room 309 at the Roundhouse.

Supported decision making (SDM) is a nationally recognized framework that allows individuals to retain their legal rights while receiving assistance in understanding, evaluating and communicating important life choices, such as health care, housing, and financial matters. In contrast to adult guardianship, SDM does not make the decisions for the person, but rather allows the individual to make decisions guided by their supporter

“Adults in New Mexico deserve the dignity of being able to make their own choices” said Emily Kaltenbach, ALTSD Cabinet Secretary Designate. “This bill provides a less restrictive and compassionate alternative to adult guardianship for those where supportive decision-making is applicable. It prioritizes personal choice, strong community support, and individual independence.”

Under HB149, adults, including those with disabilities and who are older, will have the legal right to enter into SDM agreements and formally designate a trusted supporter –such as a family member, friend or advocate—to assist in their decision-making processes.

"Supported decision should be the option we look to first,” said Rep. Michelle Abeyta. “Passing this bill would mean a crucial step towards greater independence and selfdetermination for many in our communities.”

This bill aligns with national efforts to modernize support systems for people with disabilities and older adults, and is backed by several community advocates, legal experts and disability rights organizations. Across the U.S., 27 states and the District of Columbia have successfully implemented SDM laws, leading to greater self-determination and improved quality of life for individuals with disabilities.

If the bill passes, ALTSD will continue to work with the Office of Guardianship and ensure adult New Mexicans with disabilities and older adults have options other than guardianship or conservatorship.
